Yes you can still divorce despite the Coronavirus.

Despite the world as we know it grinding to a halt the Family Court system is still open. You cannot attend courts but paperwork is still being processed and hearing are still going ahead, just in a different way. Divorce proceedings can still be issued and issues regarding financial disagreement are still being resolved through the court system. Critically issues regarding children are still going ahead as planned. If you have a court date it as things stand currently it will go ahead. Instead of attending court it will dealt with remotely via a phone link that solicitors and barristers are being given access to. This is to ensure our clients are still having access to the legal professionals they require at such hearings.

You may have wanted to start divorce proceedings and receive advice but now feel you can’t. Appointments can be done over the phone or by zoom, facetime etc just as they would in the office. You will not have to wait until normality returns to issue as this can still be done now as it could have been before. If issues cannot be agreed and court assistance is required you have to wait several months before a hearing date is obtained in any event. During this waiting time things may have improved and we are then able to return to physically attending the court. If not it is not a problem and the hearing will still proceed and hopefully a resolution achieved.
