Divorce/Dissolution Of A Civil Partnership
When a relationship unfortunately breaks down it can be difficult to know what to do first. Family and friends will try and be helpful however you really should get advice from a specialist who can answer your questions and hopefully allay any fears you may have. Everyone’s circumstances are different which does affect the outcome of each individual case.
To issue divorce/dissolution proceedings the parties need to show they have been married for over 12 months.
The relationship has permanently broken down.
The marriage is legal in the UK (same applies for same sex marriages)
In April 2022 the No fault divorce was finally introduced. This has simplified matters and taken the need to blame one party for the breakdown away and removed the need to demonstrate separation. The petition can be joint, or single and advice will be given on the best option depending on your circumstances. The process may have been changed but the emotional difficulty it causes hasn’t. Jennifer will ensure a stressful process is handled in a professional compassionate way.
Nullity and judicial separation are also an option and advice can be provided on this process if applicable.
Jennifer can provide a fixed fee divorce for a straight forward non contested case if the case is suitable. This can be discussed with Jennifer.
Separation Agreements
If you are not able to divorce or do not wish to divorce but do wish to separate you can regulate your separation by entering into a separation agreement. Clients often feel more secure and less vulnerable if the terms of separation are documented.
Advice can be given on all areas of separation and how best to proceed in this area.
Injunctions
It is a sad fact that violence does occur in some clients relationships. When clients feel able to seek assistance and protection from the courts advice can be given in this area.
“Thank you so much for your unwavering support throughout my divorce proceedings. I absolutely know that I couldn’t have done it without you. Thanks to you I am able to move forward with the kids and begin to build a new life. With kind regards.” Claire
